JAMMU: Jammu and Kashmir State Judicial Academy on Sunday conducted one day refresher course for Munsiffs of Jammu province on Civil and Criminal Laws at Judicial Academy under the guidance and patronage of Chief Patron of State Judicial Academy, Justice N. Paul Vasanthakumar, Chief Justice, High Court of Jammu and Kashmir and Committee of Judges, State Judicial Academy Justice Muzaffar Hussain Attar (Chairman) and Justice Hasnain Masoodi (Member).

Justice (Retd.) O.P. Sharma was the Resource person. The programme was conducted by Pawan Dev Kotwal, Director, State Judicial Academy. In his introductory remarks, Director, State Judicial Academy welcomed the Resource person and Judicial Officers and deliberated on the need for such refresher programmes for the Judicial Officers.

Session-I dealt with Sections 17, 18, 26, 28, 29, 35, 35-A, 35-B, 45 and 46 of the Code of Civil Procedure and Session-II was related to Sections of the Code of Civil Procedure while in Session-III discussions were held on Sections 3, 4, 8 and 9 of the Evidence Act.

Justice Sharma explained the provisions of Sections 17, 18, 26, 28, 29, 35, 35-A, 35-B, 45, 46, 47, 48 and 58 to 60 of the Code of Civil Procedure and their practical application in the first two sessions i.e. jurisdiction of civil courts, institution of suit, service of summons outside the State, imposition of costs, execution of decree and various questions to be determined by the executing court. In the last session, the Resource person dealt with Sections 3, 4, 8 and 9 of the Evidence Act and informed about the relevant facts, relevance of motive, preparation and previous or subsequent conduct of parties and test identification parade.

Justice Sharma by his long and varied experience enlightened the participants regarding ways and means which they can adopt while dealing with cases and reminded the Magistrates about their powers, duties and responsibilities in dispensation of justice. He exhorted the Judicial Officers to follow the procedural law in letter and spirit.

Participants took active part in the deliberations and raised questions during interaction with the Resource person who successfully cleared the doubts about various provisions of substantive and procedural laws.

The programme concluded with the vote of thanks by the Director, State Judicial Academy.
